We are often asked to review standard contracts, leases and other insurance terms. These documents clearly state that the parties will carry some form of insurance, and liability insurance is almost always mentioned. The lawyers who draft these contracts may be good lawyers, but they often make mistakes in the design they use to define insurance claims.
Comprehensive General Public Liability Insurance
A common mistake is to include insurance claims that include "personal injury" when what they really want is insurance that includes "bodily injury." To the common man on the street, they may seem similar, but they have contrasting and different meanings in a liability insurance policy.
Public Liability Insurance Australia
Almost all companies have standard public liability and comprehensive general liability (PL or CGL) policies that cover personal injury claims. Bodily injury refers to obvious physical injury (bruising, bruises, broken bones) or death. Optional policies can be extended to mental or emotional injury, but usually this coverage is only provided as a result of a physical injury claim (called a physical-emotional claim). Only claims for non-actual mental illness arising from purely mental illnesses such as stress, anxiety, and fear (also known as mental and emotional claims) are not personal injury claims.
Now assume that the CGL policy is a standard Insurance Services Office (ISO) form. In addition to bodily injury, this policy has a separate section covering "personal injury" claims. This section defines "personal and commercial injury" as injury, including "bodily injury" resulting from one or more of the following violations:
(3) unlawful trespass, unlawful entry, or invasion of a home, residence, or right of private occupancy of a home by a landlord, tenant, or lessor;
(iv) publish, either verbally or in writing, material that defames, defames, or disparages any person or organization's goods, products, or services;

As you can see, none of these covered personal injury crimes result from significant injury. This is an important difference between bodily injury and physical injury. Personal injury coverage in a CGL or PL policy is unfamiliar to most policyholders. Of course, there are some relevant exclusions to consider. There is no personal injury coverage for intentional acts that can raise a claim.
There are also no claims that "arising from the oral or written publication of material with the knowledge or direction of the insured that the material is fraudulent." Therefore, the insurer may have grounds to deny coverage if the insured knew that his statement was false and that knowledge of the falsehood would have been justified.
Back to the original point, personal injury and bodily injury are clearly not the same thing. When reviewing or negotiating a lease or contract, be wary of "personal injury" insurance claims when it's clear what's really needed is personal injury coverage.

Like all insurance policies, liability insurance policies include exclusions, so it's important to check what they are. Here's a list of some things that aren't usually covered:
Types Of Business Insurance
In general, no. Liability insurance protects you from claims from customers, suppliers and the public. It generally does not cover employees injured on the job. This is covered by workers' compensation insurance, which is generally compulsory for Australian businesses.
However, there are some situations where you can claim for someone else's injury on your policy because they are not technical employees. For example, work experience students or workers. It depends on what your policy covers, so make sure what you are and aren't covered before you sign up.
Also, the policy will usually cover them if a public liability claim is made against your employee and they are acting in the course of their employment when they are injured on the job or cause property damage.
One of the first things your insurer will look at is the size and type of your business. For example, an eagle-jumping business may be considered more risky than a florist's. This means that a business owner may require a higher level of coverage, which in turn means higher premiums. Your insurer can also view your claim history and transaction status.
Public Liability Insurance — Do You Know What It Is And Why You Need It?
Many people believe that liability insurance is not mandatory, but depending on your business and your situation, it may be. For example, plumbers in Victoria and electricians in Queensland and Tasmania require this as part of their licences. Some professions also require you to have a minimum level of assurance to become a member of a professional association. In general, companies that engage in public affairs or operate in public spaces may benefit from this.
Whether mandatory or not, as a business owner, it's worth considering liability insurance as a financial safety net in the event of the unexpected.
