Legal Help For Disabled Veterans - The US Honor Veterans in Extreme Need Act of 2019, or HAVEN Act, was passed on August 23, 2019. The law has important implications for veterans who have filed for Chapter 7 and Chapter 13 bankruptcy. After all, nearly 15% of those in the United states are filing for bankruptcy, they are veterans (only 10% of the total population).
The HAVEN Act, by amending the Bankruptcy Code, excludes many benefits from the debtor's normal monthly income during the vehicle inspection. Therefore, it is not necessary to take into account the benefits that a person may receive from the US Department of Veterans Affairs (VA) and the US Department of Defense (DoD). Before the law change, many veterans were forced to file for Chapter 13 bankruptcy.

Chapter 13 filings limit the amount of debt that can be discharged. It requires the borrower to repay a portion of the debt within a three- to five-year court-ordered repayment plan.

The income test calculates whether the borrower's income exceeds the median income of similar households in their state. Otherwise, they may be eligible for Chapter 7 bankruptcy on the grounds that they do not have enough income to repay their creditors. Before the law took effect, service members were required to file for Chapter 13 bankruptcy, even though similarly situated individuals already receiving Social Security could pay off their debts by filing for Chapter 7 bankruptcy.
Only those who received Social Security retirement, Social Security disability, and Supplemental Security income prior to the HAVEN Act are exempt from the vehicle test requirements. Now, VA and DoD benefits such as Permanent or Temporary Disability Retirement Benefits, Disability Severance and Retirement Benefits, or Pre-Existing Disability Benefits will not be considered when checking a vehicle.
Other excluded benefits include special combat-related compensation, Chapter 61 retirement benefit plans, special survivor's compensation benefits, and special special needs support compensation. VA veterans' disability compensation, VA veterans' alimony and compensation benefits, and VA veterans' pensions are also excluded from the vehicle test.
However, the HAVEN Act helps many disabled veterans who would otherwise be forced into a Chapter 13 bankruptcy plan. Instead, by filing for Chapter 7 bankruptcy, their debts can be settled regardless of benefits affecting eligibility.
