Las Vegas Justice Court Administrative Order 21-08 was signed Tuesday. He says the court will now be open on Fridays from 8am to 4pm. with immediate effect.

As of July 2020, the court was closed on Fridays as part of a cost-cutting measure due to the pandemic.
Nevada Legal Services says the timing of this order is disappointing and "...was issued with virtually no warning." They fear that some residents could end up homeless because of the filing technique.
That's because the order changes how the number of days for a tenant to respond to an eviction notice is counted. Tenants will have at least one less day to respond, and possibly more depending on the day of the week they are served.
This only applies to cases in the Las Vegas Court of Justice. The North Las Vegas and Henderson tracks will remain closed on Fridays.

This past Tuesday afternoon, July 27, 2021, the Las Vegas Court of Justice issued Administrative Order #21-08 ordering that, effective immediately , the Las Vegas Justice Court will be open on Fridays. Our office was just notified of this administrative order this morning." "This action is particularly important in the case of eviction notices, which require the tenant to file a response to an eviction notice (tenant's statement) within a limited number of days. By adding another court day to the week, a tenant now has 1 to 4 fewer days to file a tenant statement with the court. How many days less depends on the day the eviction notice was served and how the court day count is affected by weekends. For example, in the case of an eviction notice for non-payment of rent, which gives 7 days to file a tenant's statement, is made on Monday, the tenant now has 1 day less to file. However, if this eviction notice is served on a Tuesday or Wednesday, the tenant will now have 4 days less to file than before this administrative order was issued.” "If the tenant does not file the petition within the specified time period, any attempt by the tenant to file a tenant's declaration will be denied and the court will issue an eviction order at the landlord's request without a hearing or any other opportunity for the tenant to declare a defense.” “Our office is very disappointed in the timing of this administrative order and that it was issued with virtually no warning. The CDC moratorium will expire in two days. This moratorium has prevented countless Las Vegas residents from being evicted and left homeless during this Covid-19 Pandemic. With the lifting of this moratorium, the number of evictions carried out is expected to skyrocket starting next week. At a time when many of our Las Vegas residents are struggling to keep a roof over their head and food on their table, the time frame for filing notices was immediately shortened. More importantly, however, countless tenants awaiting eviction notices have been advised by our office and other attorneys not to count Fridays when calculating the time to appear. There is no time to adequately inform all these tenants that if they count the days according to the recommendations, they may end up with a late filing, having their tenant stand by the st's statement was denied for early filing, with what it's basically a standard eviction order issued against them, and they were locked out of their homes a few days later. While the exact number is unknown, there is no doubt that this administrative order will render many of our Las Vegas residents homeless on a technicality. It's unfortunate to say the least."

Legal and non-legal days are defined by Nevada Revised Statutes 1.120 and 1.130 and include essentially any day. that court business may be conducted except on Sundays and statutory holidays. Further, JCRCP 77(a) states: "Courts of justice shall be deemed to open at any time for the filing of a petition or other relevant document, to issue and return interlocutory and final process, and to make and govern all motions, orders and provisional rules.” JCRCP 77(d) provides that "Nonjudicial days for justice courts are the same as for district courts. If any day on which an act required by any of these rules falls on a Saturday, Sunday, or legal holiday, the act must to be carried out on the next day of the trial." Currently the district court and the court have joined together to allow 13 Customer service windows will be staffed Monday through Friday by Civil Law Self Help Center staff and volunteers to help tenants file documents In addition, the Civil Law Self-Help Center at Legal Aid of Southern Nevada offers weekend pop-ups clinic to help tenants. This extension has had a significant impact on the number of tenants responding to eviction notices by filing an affidavit with the court. Historically, only about 25% of tenants responded to eviction notices. This number increased to 66% in June 2021 and to 95% in the first half of July 2021. In addition, nearly 85% of tenants submit their statements to the court electronically instead of submitting a paper document to the clerk's window. A review of records related to community needs showed the clerk's office served about 1,300 clients on Fridays. Whether by election, business hours or otherwise, the Las Vegas Justice Court did not want to deprive this segment of the community of the opportunity to access the court for their needs.
